Most people who get cheated by a company in India do nothing, because filing a consumer court complaint sounds complicated. It isn't. The forum is free, the process is straightforward, and the compensation can cover mental agony on top of your losses. Here is exactly what to do, from sending the legal notice to walking into the redressal forum.

Send a Legal Notice Before You File Anything

Chanakya wrote in the Arthashastra that a dispute resolved before it reaches the king's court costs far less than one that doesn't. The consumer court system in India operates on the same logic: you must send a written legal notice to the company before filing, and this step alone resolves a surprising number of complaints. The notice does not need a lawyer. Write it yourself. State the product or service, the exact defect or deficiency, the amount you are claiming, and give the company 15 days to respond. Send it by registered post with acknowledgement due, keep the receipt. If the company ignores it or sends a dismissive reply, that silence becomes evidence in your favour when you file. One practical detail most people miss: address the notice to the company's registered office, not the local store or branch. The registered address is on the company's website under "About Us" or on the MCA21 government portal. A notice sent to the wrong address can be ignored without consequence.

Choose the Right Consumer Forum for Your Claim Amount

India's Consumer Protection Act 2019 divides jurisdiction by the value of your claim.1. District Consumer Disputes Redressal Commission, claims up to Rs 50 lakh. This is where almost every individual complaint lands.2. State Consumer Disputes Redressal Commission, claims between Rs 50 lakh and Rs 2 crore.3. National Consumer Disputes Redressal Commission, claims above Rs 2 crore.File at the commission in the district or state where you live or where the transaction happened, whichever is more convenient for you. The 2019 Act gave complainants this choice specifically to reduce the burden of travelling to the company's home city.Filing at the wrong level is a common mistake that wastes months. Calculate your total claim carefully: add the product cost, service charges, any documented consequential losses, and the compensation you are claiming for mental agony. That final number determines your forum.

What Your Complaint Document Must Contain

The complaint is a written document, not a form. It should read like a clear, factual account, not an emotional letter. Courts respond to specifics.Include: your full name and address, the opposite party's name and registered address, a chronological account of what happened, copies of every document (bill, warranty card, email chain, screenshots, the legal notice you sent, and the delivery receipt), and a specific prayer clause that states exactly what you want, refund, replacement, repair, or compensation, with the rupee amount. The filing fee is nominal. For a claim up to Rs 5 lakh, it is Rs 200. For claims between Rs 5 lakh and Rs 10 lakh, it is Rs 400. These fees are set by the Consumer Protection (Consumer Disputes Redressal Commissions) Rules 2020 and are not subject to a lawyer's markup. You do not need a lawyer to file or to appear. The consumer redressal system was designed for self-representation. A well-organised complaint with clean documentation often performs better than one buried in legal language.

How to File Online Through the E-Daakhil Portal

The National Consumer Helpline's e-Daakhil portal (edaakhil.nic.in) lets you file a complaint, pay the fee, and track your case without visiting the forum in person. Registration takes under ten minutes with an Aadhaar-linked mobile number.Upload your complaint document as a PDF, attach all supporting documents, and pay the filing fee online. Once submitted, the forum issues a case number and schedules a first hearing. You will receive updates by SMS.The portal covers District Commissions in most states. If your state's District Commission is not yet on e-Daakhil, you file physically at the commission office, bring three sets of the complete complaint package (one for the commission, one to be served on the opposite party, one for your own record).

What Happens After You File, and What You Can Actually Win

After filing, the forum serves notice on the company. The company has 30 days to submit a written reply. Hearings proceed from there, typically over several months depending on the commission's caseload. The Consumer Protection Act 2019 allows the forum to award: a full refund, replacement of the product, removal of the deficiency in service, compensation for mental agony and harassment, and the cost of litigation. Compensation for mental agony is not a formality, District Commissions regularly award amounts between Rs 5,000 and Rs 50,000 for harassment alone, separate from the principal claim. If the company does not comply with the order within 30 days of it being passed, the forum can attach the company's bank account or property. Non-compliance with a consumer court order is a criminal offence under the 2019 Act, punishable with imprisonment. The legal notice, the documented paper trail, and the choice of the right forum are not procedural boxes to tick. They are the architecture of a complaint the company cannot dismiss, because each step removes one more exit the company might otherwise take.
