Almost every rental agreement in India runs for exactly 11 months, and almost no one who signs one knows why. The answer sits in a single clause of the Registration Act, 1908. Understanding it takes about five minutes. Knowing what happens when you skip registration entirely could save you a court date you never wanted.

The 11-Month Rule Is Not a Tradition, It Is a Legal Workaround

Under the Registration Act, 1908, any lease agreement for immovable property that runs for 12 months or longer must be compulsorily registered with the Sub-Registrar's office. An unregistered lease of 12 months or more is not merely informal, it is inadmissible as evidence in a court of law. Landlords discovered, decades ago, that stopping at 11 months keeps the agreement outside that mandatory threshold. No registration means no stamp duty on the full lease value, no Sub-Registrar appointment, and no court-admissible document that a tenant could use to claim tenancy rights beyond the agreement period. The 11-month agreement is renewed, often indefinitely, rather than converted into a registered lease. This is legal. It is also a calculated choice that benefits the landlord far more than the tenant.

What Stamp Duty Actually Costs and Who Pays It

Stamp duty on a rent agreement is calculated on the total rent payable over the lease period, sometimes including the security deposit. The rate varies by state. In Maharashtra, stamp duty on an 11-month agreement is typically 0.25% of the total rent for the period plus the deposit, subject to a cap. In Karnataka, a fixed stamp duty applies for agreements under 11 months. In Delhi, it is calculated on average annual rent. These are small numbers for a short lease, often between ₹500 and ₹2,000 for a standard residential rental. For a registered 12-month-or-longer lease, the stamp duty climbs because it is calculated on the full lease value, and registration charges, usually 1% of the lease value subject to a ceiling, are added on top. The landlord typically asks the tenant to split or bear this cost. The 11-month structure eliminates that conversation.

How to Actually Register an Agreement When You Choose To

Registration is not compulsory for 11-month agreements, but it is available and often wise. A registered agreement, even a short one, is admissible in court. Here is the process in most states, though specific documents and fees differ by state government portal.

First, draft the agreement. It must state the names and addresses of both parties, the property address, the monthly rent, the security deposit amount, the start and end date, and any clauses on maintenance, notice period, and permitted use. Have it reviewed before signing.

Second, print it on stamp paper of the correct value for your state, purchased from a licensed stamp vendor or through your state's e-stamping portal, Maharashtra uses GRAS, Karnataka uses Kaveri Online Services, Delhi uses SHCIL. Do not buy stamp paper from an unlicensed source.

Third, both parties and two witnesses sign the agreement in the presence of the Sub-Registrar. Bring original identity proof, address proof, and passport-size photographs for all four people. The property documents, typically the owner's sale deed or property tax receipt, must also be presented.

Fourth, pay the registration fee at the counter. You will receive a registered copy, usually within the same day or within a few working days depending on the office's workload.

Several states now allow online or doorstep registration for rent agreements. Maharashtra's Leave and Licence registration can be completed entirely through the Inspector General of Registration and Stamps portal without visiting an office.

What an Unregistered Agreement Cannot Do

An unregistered 11-month agreement is not worthless. It is valid between the parties as a contract. It can establish the terms of the tenancy, the rent amount, and the notice period. A landlord can use it to initiate eviction proceedings under state rent control laws. A tenant can use it to show they were in lawful possession.

What it cannot do: it cannot be produced as primary evidence in a property dispute. Under Section 49 of the Registration Act, 1908, an unregistered document that is required to be registered cannot affect immovable property or be received as evidence of any transaction affecting such property. For a 12-month-or-longer lease, this is a serious gap. For an 11-month agreement, the legal exposure is lower, but if a landlord denies the terms of the agreement in a dispute, the tenant's position is weaker than it would be with a registered document.

The Tenant's Calculus

Chanakya wrote in the Arthashastra that a person who does not know the rules of a transaction is always at the mercy of the person who does. The 11-month structure is not illegal, but it is asymmetric. The landlord retains flexibility: the agreement expires, and renewal is at their discretion. Long-term tenancy protections under older state rent control acts, which in some states made it very difficult to evict a tenant who had been in possession for years, apply differently to leave-and-licence agreements than to lease agreements. Many landlords switched to the leave-and-licence format specifically to preserve their right to reclaim the property.

A tenant staying long-term in a city is not obliged to accept an 11-month structure indefinitely. A registered lease of two or three years, with a proper termination clause, gives more stability. The landlord may refuse. But knowing what you are agreeing to, and what you are giving up, is the starting point of any negotiation worth having.
